Police video shows that an eighth-grade student from Hialeah in Florida confessed under questioning to the police that he had killed his mother by stabbing her with a large knife in the throat in October.
Derek Rosa, 13 years old, is accused of killing his mother Irina Garca, 39, by stabbing several times in her chest on October 12, while his infant sister slept in a crib next to the room where the murder took place.
Rosa, who had been charged as an adult with murder, pleaded no contest to the charge on October 31.
The Hialeah Police Department released a video recently of Rosa’s questioning. Detectives read her Miranda Rights before she revealed that she is an eighth-grade student who gets A’s or B’s.
The investigators also learned that his time was divided between him and his parents.

Rosa, the investigator, told them that on the day Garcia was murdered he rode the bus to the school, didn’t do much there and then rode the bus back home where he spent the rest of the afternoon.
Things changed around 10 pm.
Rosa told investigators that he and his mother went to sleep around 10 p.m. His mother and sister share the same room as his father.

Rosa said to detectives, “I woke, went to the house, grabbed a kitchen knife, then went into her room, and I …,” Rosa.
Rosa was told by one of the detectives, “It’s okay. You can say that.”
He confessed, “I murdered her.”
The detective then asked the boy, “You killed her,” before he nodded.
Rosa was asked about the knife. He took his hands out and showed it to the detective. Rosa was not certain what kind of knife it was and it had a violet handle.

Rosa admitted to detectives that he had intended to kill himself but called 911 instead and asked the police to attend his home.
Rosa , when asked by the detectives how he killed her mother, said on video that she was cut on the neck with an artery stuck.
Garcia had stabbed her neck “intentionally” after uttering curse words in Spanish.
Rosa claimed that after killing his mother he took one of his stepfather’s guns and put a magazine into it. He then pulled the slide back, but was unable to kill himself.
He called a friend he had met through online gaming to tell him he’d killed his mom, then sent two photos of her and one of himself.

Rosa said that the friend told him he couldn’t believe what Rosa had done. Rosa, after saying goodbye to his best friend, told detectives that he was going to kill himself but instead called 911 to ask for police to be sent to the house as he killed his mother.
Rosa was asked by the detectives why he had stabbed his mom. He replied that he needed to go to the bathroom first before he answered.

Rosa was then asked to return four minutes later and tell the detectives what video games she plays. The boy said he had an XBox 360, Nintendo Switch, VR headset and he liked to play Fortnite and Call of Duty.
The detective then asked why the man killed his mother.
Rosa asked, “Do I need to say it right now?”
One of the detectives replied, “Yeah. Get it off your chest.”
Rosa asked the detectives, “Can I hold off until I get a lawyer?”

Rosa was told by one of the detectives that they weren’t there to tell him whether or not he should hire a lawyer, but to let him make the decision.
The detective asked Rosa whether he wanted a lawyer, as the interview was at this point unable to continue.
The detective asked him, “Do you wish to end the interview?”
Rosa replied “Yes” before the detective concluded the interview and switched off the camera.
Rosa could be tried next month.
