Nicholas Joseph Gutierrez 22, a 22-year-old man who was accused of deliberately running over more than 25 Los Angeles sheriffs recruits with an SUV, was released from jail only days later.
Authorities released the following statement: “Due to the extremely complex investigation, which includes ongoing interview, video surveillance review and additional evidence required to analyze, homicide investigators had to release Mr. Gutierrez from Sheriff’s Department custody.”
From The New York Post
Nicholas Joseph Gutierrez was arrested for attempted murder of a police officer. He was released at 9:49 on Thursday, according to jail records. CNN reported.
CNN was told by Deanna Mares, LA County Sheriff’s deputy that Gutierrez was released because investigators needed more time to gather evidence for the district attorney’s offices.
Mares stated to CNN that it wasn’t like they had arrested the wrong suspect. They just want to ensure that the investigation is complete.
She explained that the sheriff’s office must usually present a case within 48 hours of an arrest to the DA. Gutierrez was not ready for this explanation.
Sgt. Gerardo Magos , the Sheriff’s spokesman, told the LA Times the authorities intend to arrest Gutierrez after further investigation. They will then present the case to DA’s Office.
“The evidence is already there. He said, “We just want it to be properly presented.”
According to the LA Times, the initial arrest of the suspect was deemed detention.
