According to court records, Jay Johnston is facing charges for felony obstruction of police officers during civil disorder and several misdemeanors.

In December 2021 , The Daily Beast stated that Johnston was “banned” by “Bob’s Burgers”, where he voiced Jimmy Pesto Sr.

Johnston is among hundreds of Jan. 6, 2016 participants who have been identified by online detectives but not yet arrested. On Wednesday , a funeral home owner from Long Island was arrested.

Documents from the court state that Johnston entered upper west tunnel where the violent attacks on Jan. 6, took place, and “assisted three other rioters” by pouring water onto their faces. The documents state that he then used a stolen U.S. Capitol Police Shield as rioters fought with police.

According to the FBI, an attorney representing Johnston called the National Threat Operations Center in March 2021. Three Johnston associates, either current or former, told the FBI the photos taken on January 6 depicted Johnston. One of those associates sent a message to the FBI in which Johnston admitted being at the Capitol that day.

In connection with the Capitol Attack, more than 1,000 people were arrested. Hundreds of arrests will be made in the near future.
