Kennedy was determined to not give up.
Louisiana Senator John Kennedy (R), threw softball questions at Kato Crews during Wednesday’s confirmation hearing. Crews couldn’t answer them.

Crews was nominated for the U.S. District Judge position. Kennedy asked Crews how he would “analyze Brady motions” and Crews replied that he hadn’t “had the opportunity to address Brady motions” in his four-and-a-half years on the bench.
Kennedy asked Crews, after he had lost the answer, if he knew what a Brady motion was.
Crews, currently a magistrate judge said that the idea was “not coming into mind” because he had never dealt with the matter before. Kennedy asked Crews if he remembered Brady v. Maryland, and what that case contained.
Crews replied, “I believe the Brady case was something regarding the Second Amendment.” Crews replied, “I haven’t had the opportunity to address that.”
A Brady motion is a legal concept. It was created by the landmark Brady v. Maryland Supreme Court 1963 decision, which stated that the prosecution must give potentially favorable evidence to defense.
