After being sued by Brittanee’s mother in 2009, the South Carolina resort disputes claims that they allowed the 17 year old New Yorker check in prior to her kidnapping and murder on a spring break trip.

Dawn Pleckan filed a lawsuit against Raymond Moody (the man who murdered her daughter), Bar Harbor Resort Inc., and Smith Family Partners LLC on Jan. 2, 2020, accusing them of “wrongful conduct,” which led to Drexel’s murder in April 2009, while she was in Myrtle Beach, South Carolina, with her adult friends.

The group stayed at the Bar Harbor Hotel in Myrtle Beach, which is owned and operated jointly by Bar Harbor Resort Inc. and Smith Family Partners, LLC. Pleckan’s suit states that Brittanee stayed at this hotel and was unaccompanied at all times. The hotel and its operating company profited from the transaction.

The lawsuit also states that “in April 2009, the hotel and its operating groups had no policies to detect and alert the law enforcement of the presence of unaccompanied children traveling without their legal guardians and/or parents… which could have prevented rape or murder of Brittanee.”

Pleckan also claims that the hotel’s owners “created, fostered, and maintained an environment in which minors including Decedent could stay unaccompanied on their premises.”

The lawsuit contains screenshots of reviews that are negative for the hotel and allege nefarious activities.

The lawsuit claims that “Decedent fell into the foreseeable risk zone created by Hotel Defendants misconduct alleged above as she was a minor unaccompanied female who was brutally abducted, raped and murdered during her visit.”
