The lawsuit refers to the Prison Rape Elimination Act of 2003 (PREA), which seeks mitigation and eradication of rape incidents within correctional facilities.

The lawsuit, filed in August 2023, and obtained on Saturday by Fox News Digital, establishes Miles’s birth as a man biologically, but his identification as a woman transgender.

The lawsuit claims that “Miles is dressed in women’s clothes and appears to be a woman.”

According to the lawsuit Miles “was placed in a male housing unit despite [her] objections, her court orders, and requests to be accommodated with women.” Miles’ lawyer also claims that defendants “delayed or denied her access to health care.”

The document states that “[Miles] suffered from permanent blindness after being doused with chemicals in her face.” All of this has caused her pain and lasting harm.

“Defendants’ illegal conduct was a result of Rikers’] widespread practices and customs, of discrimination against transgender individuals, as well as deliberate indifference.”

Miles’ attorney also claimed that New York authorities ignored her “repeated pleas for assistance and protection from threats and sexual victimization which they had exposed [her] to.”
