On Monday’s Mark Levin Show, there’s a full-scale effort by President Biden and his surrogates to suggest that Biden has the power to use the 14th Amendment to lift the debt ceiling.

Hello, America. Mark Levin is here. Our number 87738138118773813811. My friend Chip Roy will appear on the show later. Since a long time we’ve been friends. I’d like to hear his opinion on the budget, but first I would like to spend some time with you. Biden and the Democrat Party are attempting to convince the public that Joe Biden is able to break the separation of powers in order to take away the core functions of Congress. This is the House of Representatives. To borrow, to spend, and to tax. They then wrap themselves up in the Constitution, while they are violating the Constitution. This is how they operate, as I have told you many times. They promote liberty, but also tyranny. So I will break it down once more. As you may know, I spoke on Life, Liberty and Levin in my opening statement. Some people ask, “What do you call a monologue and not an opening statement?” Most people don’t. Only a few idiots. I said it because I dislike the word monologue. It’s a statement I make, an assertion or argument that people can accept or reject. But I did go through it fairly in-depth. On radio, obviously, people come and leave. On TV, they come and go. They might not be watching. Who knows? Doesn’t matter. I want to be sure that I have the case in front of me because now we are getting to the meat and potatoes. First, let’s begin. Joe Biden, the alleged offender. You should think about Donald Trump. Ronald Reagan. Bush or Reagan. To issue bonds. I am the only one with the power to act unilaterally. I have the unilateral power to raise the debt ceiling. And I did have the power. My party also had the power of passing a budget which was out of control. Now I am in control. Force the American people into paying for it. This is the height of totalitarianism and dictatorship, ladies and gentleman. Laurence Tribe, and all the other old scumbags out there who twist the Constitution to suit their own needs are not important to me. This is not acceptable. Period. Here’s Biden, in Hiroshima Japan. His question was yesterday asked by by the dosage. Peter Doocy Cut and go, Mr. President, you said that I would do my part. Do you believe that there’s a reason for this? I don’t see a reason. Yes, of course. No blaming. I know you will not. You’ll say Biden did an amazing job. You’d be blameless if you accepted what I offered. On the political side, I’d be blameless. No response, Ms.. By the way, this is one of those things that some people are considering. I had to be careful. There are some things that you can say to tell if he is losing. It’s painful, isn’t it? The majority of it is. He says, “Anyway.” I believe there are MAGA Republicans. Go ahead. You can go ahead. This is really outrageous and frustrating. He behaves like MAGA Republicans – that is, Republicans who support Donald Trump and have done so in the House. By the way. You’re all kamikazes, 75 million of us. The kamikaze was mentioned in relation to Hiroshima. You’re the ones that want to bring down the economy. He spends like a drunken Marxist. He demands that Republicans raise their debt ceiling to cover his and McConnell’s spending. They say, “No, we have to start trimming this budget, trim sales,” and they aren’t even talking about an enormous amount of money. Now there are MAGA Republicans that want to bring down the economy. As I have said before, this guy is a horrible, evil street politician. As I have said repeatedly, he is a serial liar. All he is. Go ahead. You can blame me for anything because I’m president. That’s how you can make sure Biden is not reelected. Aren’t you? What hope do you have for Biden? Biden? Biden? When you make these remarks, you are not even in America. You are in Hiroshima Japan. McCarthy has repeatedly said that you’ve been there for 97-days. My calculations show that this is over three months. He could not get a call from Biden or an appointment with him. Now, here’s why. Biden and Democrats thought they could play chicken with the Republicans and they would give in. They thought the House Republicans would not stay united. They were wrong, and thought they would be hacked to pieces by Senate Republicans. Some. Mike Lee, however, took on the leadership of the Senate to get 43 senators to sign a support letter for what the House Republicans had done. You’ll want to keep this in mind as you debate with your friends, family and neighbors. The Republicans have already raised the debt ceiling. They want cuts. They already voted in the House to bring it up. Schumer will not put it to a vote. They want to cover all expenses, no matter what. They want to cover all spending, no matter what. Spending is out of control. What about the 14th Amendment, which we have discussed in detail? This is something we’ve been discussing for months. I remember talking about it many years ago. The 14th Amendment. What is the 14th Amendment all about? Does it give the president the right to borrow money unilaterally? Does this even make sense to anyone? Anyone ever tried that? No. Why now? Why even try to negotiate with Republicans in Congress if it’s written in the 14th Amendment? It’s written in the 14th Amendment. Why waste time in Congress? What if it’s in 14th Amendment? Do it. If you believe you can do it, you don’t need to wait until the break. You could have done this five months ago. Frightening, isn’t it? To achieve this, we fought a revolutionary war. To get rid of a monarchy, a representative government is incredibly useful. We have this guy. Here’s the guy. Three cuts. Go. The 14th Amendment is what I am looking at to see if we have the authority. I believe we do have the authority. It is a question of whether it can be done in time to prevent it from being appealed. As a result, I don’t think that the question is resolved. Listen to what he started with. We are the authorities. He said, I quote unquote. I believe we are the authority. He believes that he has the authority to do so with his magic wand. To issue bonds. Other Treasury instruments Other Treasury instruments. Although Article one explicitly provides. Congress has these powers. The 14th Amendment doesn’t count or it doesn’t change anything. This has nothing to with the 1868 amendment. Was everything about. After this civil war, the debt was to be paid. What debts would be paid, and what dead wouldn’t be. Laurence Tribe, who is a spokesman for the group, says that it has nothing to do with today’s events. He’s a stupid jerk. Obama even understood it in 2011. Now, I’m going. The gentleman inquired about the 14th Amendment. In our Constitution, there is a clause that talks about the United States meeting its obligations. There have been suggestions that the president could use this language to ignore the debt ceiling rule. This is a statutory regulation. It’s a statutory rule, not a constitution. I’ve talked to my attorneys. They do not. They don’t. They do not believe that this is a convincing argument. The challenge is for me to find a way that’s very convoluted to say, “No, I do not I do not have this power.” Now. You know why. Michael McConnell. He was also a federal appeals judge as well as a Stanford Law professor. He was a leading lawyer for a long time. But OMB was in the Reagan Administration, you know the old Reagan Administration that did nothing. Maybe we should think of someone else and forget about Reagan. He wrote recently in The New York Times. Biden plays a dangerous game. The federal government is on the verge of exceeding the amount Congress authorized to be borrowed, and its treasuries are running out of what’s known as “extraordinary measures” to stave off calamity. Congress and the President must reach a compromise or else the country faces default. The House of Representatives passed a bill to raise the debt limit of the country by 1.5 trillion. By 1.5 trillion. This is not joke money. This is a lot. But, the proposed cuts in spending are also a factor. The Republican leadership has also signaled their willingness to negotiate. Biden has instead demanded that Congress increase the debt ceiling without any conditions. House Republicans insist on negotiations and a compromise. This is not hostage-taking, quote unquote. Politics is just the normal stuff. Both sides can pose all they want but, in the end Congress and the President have to come to an agreement. It’s not bad. It’s good that the Constitution doesn’t allow either side to take a unilateral approach. Start with the basics of constitutional law. In Section 8 of Article 1, Congress’s powers are listed. Section eight’s first clause states that Congress can lay and collect taxes. The second clause gives Congress the power to borrow on credit of the United States. These clauses have absolute force. The executive branch is not allowed to impose taxes on its own or borrow money. These powers, along with the spending power, are collectively known as the purse power, and they belong to the entire legislative branch. The provisions are a prominent part of the powers Congress has. The Stuart Monarchs claimed the right to tax and borrow, and to rule, without the approval of Parliament. This led to autocratic rule in the country, periodic defaults on royal debt, astronomical rates of interest for government borrowing, and eventually civil war. Our framers did not want to recreate the Stuart Monarchy, and the first two paragraphs of Section 8 reflect this aversion. However, the power of money may be the most important element of our system of checks-and-balances. Joe Biden is trying to take them away from the House of Representatives. The way that this story is being reported has me appalled and disgusted. The debt ceiling is nothing but an authorization by Congress to borrow up to a certain limit. A certain limit. The debt ceiling does not restrict the borrowing power of the president. The executive branch is authorized to borrow only up to the debt ceiling. The president cannot go above that limit. Biden’s advisors are reportedly considering a violation of the congressional debt ceiling based on an absurd interpretation of Section 4 of the 14th Amendment proposed by academics. This idea has been floated by previous administrations, but they have all rejected it. Biden should follow suit. This would distort the 14th Amendment’s words, ignore its historical context and cause the markets to go into chaos. As he talks about it, I will dig deeper into it. I have done so many times before. But I do want to be clear about what Biden said. Yesterday, in Japan. He has the authority. So I hope you understand. Biden has just made a statement. He has dictatorial power. Since the 14th Amendment, no president has ever claimed to have dictatorial powers. There’s more. I’ll be back in a moment.

Ladies and gentlemen, it’s not difficult. After the Civil War, the Republicans passed the 13th Amendment and the 14th Amendment. The Republican states. The aftermath of the Civil War was their concern. The 14th Amendment does not have anything to do with who is in charge of the country or its finances. Some. What’s the matter? Let’s see. The majority of 120 years later ended 1865. My math isn’t great. It’s been 160 years. It would not have happened. States would have never ratified a constitutional amendment giving the power to collect money for the payment of debts to the President of the United States. Ever. They didn’t. The 14th Amendment does not. This is a topic we have to discuss. I’m sorry, but it seems like we are in an endless situation of having to defend our Constitution word for word, line by line. We’ll do it if necessary. I’ll be back in a moment.

I challenge Laurence Tribe. I challenge anyone who believes that the 14th Amendment gives Biden the right to unilaterally increase the debt. They were challenged to name a single congressman. Who said this in 1868? I challenged them. Single. State senator or representative. Who said that such a thing won during the 14th Amendment ratification? They must find at least one speech. These members are many. What they say today is what the 14th Amendment means. Nothing, none of the above. Nothing. And I enjoy good debate. Yes, I do. In the coming days, it will be clear to you all. This is what I said. There’s nothing. We’ll continue. Michael McConnell is not to be mistaken with Mitch McConnell. The 14th Amendment’s Section 4 was enacted after the Civil War and states that the legitimacy of public debts authorized by law in the United States cannot be questioned. The purpose of the media was to stop future Congresses from renouncing pension obligations and debts incurred in order to win Civil War. It is true that it extends beyond these narrow circumstances. However, by its own terms, the clause does not allow for the President to take out more loans in violation of article one, section eight, clause 2. Article section clause which explicitly says folks me talking now empowers Congress. Congress. By its terms. The president is not authorized to borrow any more money. In violation. It does not authorize the president, either, to impose taxes that violate Article 1, Section 8, Clause One, which again gives the power to Congress. According to its terms. The president’s power is not increased in the slightest. Section four has nothing to do with the payment of national debt. The United States running out of money is not unconstitutional. It’s a nice idea, but it is impossible. The section four of the Constitution prevents Congress from denying the validity of the debt. He writes that it would be financially disastrous for the United States if they failed to pay their debts, including interest and principal, but this would not have any effect on the validity of the debt, as long as the borrowers are paying on legal debt. Quote, unquestionably unquote, this does not affect the validity of these debts. They are still liable for their debts. Just that the borrowers have defaulted. I’ll explain more about that in a moment. Even if the President were to issue new bond without congressional approval. He has no power to do this. This section explained to him that these bonds were not constitutionally binding. The only public, that is authorized by law unquote (meaning by statute), has this status. If President Biden issued bonds unilaterally, the bond market knew that these bonds were not backed with the full faith of the United States. Biden, ladies and gentleman, has no greater authority than me to issue bonds. He’s none. Investors who are sensible would never buy such bonds, or demand a risk premium so high that they would be uneconomical. Despite the fact that some people believe the Supreme Court will resolve the issue of the new debt issued by the President’s Party, the bond market would actually be the one to do it. The resolution would be not a happy one. This is why Biden mumbles. I don’t believe I can invoke the app in time. Michael McConnell says President Biden only has one choice to avoid default. He must negotiate with Congress. The government branch that has the authority to borrow and spend. It’s not a catastrophe if that means agreeing on spending reductions. This is hardly a catastrophe, especially when you have a Marxist budget that’s fat and bloated. Please excuse me. These are my words, which previous presidents did. In fact, when Mr. Biden was Vice President, he negotiated a similar deal with Obama at the Congress. It is dangerous to believe that the 14th Amendment grants the president unilateral borrowing power. Nonsense. Dangerous nonsense. Biden claims to have this power, but he denies it. What do you think of this, America? This is where the Democrats will be. Stephen Cohen is a low-IQ reprobate from Tennessee. They want to destroy the building. They are the MAGA Republicans and not the Marxist Democrats. You are familiar with Republicans. Do you not think that it is time to get involved in this fight? He had some dirt under your fingernails. Maybe dirty hands. Do you not think that it is time to call them what they are, Marxists? They make up names for themselves. They call you the boomer generation, or other names like MAGA Republicans. Don’t you agree that it’s about time you got real now? He is called the Marxist they are. Janet Yellen, a.k.a. Janet Yellen at Meet the Press Listen to what she says. It could be very interesting. Chuck Todd is there, of course. But nothing is interesting. It’s dull and stupid. Cut out sex. Go. Does the 14th Amendment come under the category “extraordinary measures”? Is this a sentence Mr. Producer? Does the 14th Amendment come under extraordinary measures? Isn’t literacy a requirement at the very least for someone who holds a position such as that of the structure? The 14th Amendment is not about the King’s English. It’s just basic literacy. Could you repeat it, Mr. MATTHEWS. Does the 14th Amendment come under extraordinary measures? Does the 14th Amendment fall under extraordinary measures? What I’ve heard is correct. Wow. Okay. What is her answer? Let’s go. The 14th Amendment has not been discussed much. It doesn’t appear to be something that can be used in this situation, given its legal uncertainty and the short timeframe we are on. This is what President Biden stated, I think, this morning. Let’s just stop here. He can’t stop talking to this trucker who is illiterate. He’s angry. Wait, wait. I’ve got to get there. I’m so clever. She got it right half the time and wrong half of the time. He said. It’s a very tight deadline. Biden basically said that. He said he had the power to make it happen. This is a remarkable statement by a US president. He has the authority to seize unilaterally the most important, if not the most important, core function of Congress, and more specifically the House of Representatives. Joe Biden says that he can propose budgets or fund budgets without having to negotiate. Why did you wait until the last minute? Why did you wait until the last moment? Why didn’t say: This is my budget, and either you approve it or I will fund it within three months? Why didn’t the man do this? It would have been more timely. It’s not my place to give them any ideas, but it is so clearly unconstitutional and reckless that the Democrats are willing to do it. Biden, his fake professors are what they want. They are prepared to do this because they want the building to be destroyed and replaced with a Marxist paradise. Imagine the hell they will unleash. They don’t respect these institutions, neither the Supreme Court nor the United States Senate. If they can. Directly attack it. They are attacking it secretly. What have they done to the FBI and intelligence agencies? What have they done on the border? This is a wrecking team. It’s a wrecking crew. Go ahead. We hope that Congress will increase the debt limit. The debt ceiling was raised. They did raise the debt ceiling, but not as much as Democrats wanted. What’s the name of this guy? Conner’s name. What’s his name in California? Ro Khanna? I saw him lying on TV. That’s right, Ro. You are welcome to call in. I’m done. My teeth are very sharp. At this point, I’m willing to fight anyone. Roy, Ro, whatever. Come on. Come on. You said something extraordinary on television. You lied to the American public. You claimed that this budget had already been passed. True. The money has been spent. That’s false. The money will not be spent until the fiscal year ends. The fiscal year ends on September 30, not May 30. The budget has been passed. As fast as possible. The Democrats in Congress. You voted that. Well. The McConnell team and the Democrats in Senate. The. McConnell lights. They are not Republicans. They are not Republicans. All I know about them is that I don’t care for them. However, I don’t like them. Now they say, “You guys have to pay.” They rushed through that. By the way, they voted late. The budget is supposed to be passed. By the 1st of October. The strange fiscal year of the federal government started on that date. They waited until after the elections. How does it work? How do they do that? Perot voted in favor of this. He says that the next badger knows about this budget. They want to see this budget. Chuck Todd and Byron Donalds are on. CNN has Byron Donalds. He is on Meet the Press. We invited him to come on Meet the Press last week, but he cancelled. He could not make it. He was on CNN. I remember the first time I brought Byron to this show and TV. Easy come, easy leave. Let’s continue. Listen to what this is. Byron is a smart dude. Cut seven. Go. What did the former president Trump say about debt ceilings in 2019? Listen to this. I can’t even imagine anyone ever thinking about using the debt limit as a negotiation wage. Why aren’t you with him? First of all, you must stop using the debt limit as a negotiation tool. McCarthy, the conservatives and my man are the Republicans who want to save America. Joe Biden will have his way within ten years. On budget, the national debt will reach almost $51 trillion. Depending on how you count, it’s either 32.5 or 7 trillion depending on today. Is this good for America? America? We won’t be in a position to reverse that. We finally have fiscally responsible members of the House who are doing all they can to make use of their tiny majority. Up against Washington. Up against Biden. Up against Biden. McConnellites, to be honest. The media is against us. A tiny, tiny minority. They are David against Goliath and doing what they should. And we get Chuck Todd now. Chuck Todd is my wife’s husband, who gets paid as a Democrat operative to advise Democratic candidates how to become Republicans. Chuck Todd recorded Donald Trump for 2019. What did Donald Trump actually say? Let’s go back to the beginning and I will explain. Go. What did the former president Trump say about debt ceilings in 2019? Listen to this. I can’t even imagine anyone ever thinking about using the debt limit as a negotiation wage. He’s basically saying that the debt ceiling is not a bargaining chip, but a negotiation wedge. That’s. It has nothing to do budget-wise. He’s not saying anything. Use it for nothing but to make a deal. The Republicans say, “Look, we have to cut our spending.” We are not searching for a bargaining chip. We have no other option but to reduce spending. Trump didn’t spend more than Democrats. He probably spent more than we should have, but it wasn’t him who pushed the budget. It was again the Democrats. The Democrats are 10 times worse than the Republicans. I have to leave.
