NY VAX DECISION: DeSANTIS: “No One Should Have To Choose Between A Jab or a Job”

Ron DeSantis, Florida Governor, shared his views on the recent New York Supreme Court decision that reinstated employees fired for refusing the COVID-19 vaccination. The court found that being vaccinated doesn’t stop the spread.

DeSantis tweeted that “The N.Y. Supreme Court ruled against the COVID regime’s vaccine mandates” and ordered the reinstatement unvaccinated employees with back pay. “In Florida, no one was forced to choose between a job or a jab — it’s nice that it’s finally like this in New York.”

Judge Ralph Porzio is a judge on the New York Supreme Court on Staten Island . He ruled that the city’s health chief could not alter workers’ terms of employment. Also, he referred to President Biden declaring “the pandemic has ended” and Gov. Kathy Hochul (D) ending New York’s state of emergency.

Porzio wrote that “the vaccination mandate for City workers was not only about safety and health; it was also about compliance,” adding that the mandate violated employees’ equal protection rights.

He said, “If it were about safety or public health, then unvaccinated workers would be placed on leave as soon as the order was issued.” “If it were about safety and health, the Health Commissioner would issue city-wide mandates to all residents for vaccination.”

Porzio stated that there was no evidence to support keeping the public employee vaccination mandate while valeting the mandate for the private sector or creating a exemption for certain professions like artists, athletes, and performers. This is clearly an arbitrarious and capricious decision because identical unvaccinated individuals are being treated differently by the same administrative agent.
